Summary

This report gives details, for information, of action taken under delegated authority on the grounds of urgency.

A. Recommendations

That members receive the report.

B. Supporting information

1. Standing Order 6.1 provides for the Chief Executive or Treasurer to take decisions under delegated authority and in consultation with specified members where a decision is required urgently. Decisions taken in this way have to be reported to the next meeting of the Authority for information. This report must state which members were consulted. Under the urgency procedure, wherever possible the members of the relevant committee (or of the Authority if that would be the decision-making body) should be informed in advance of the proposal to take a decision. This action must also be reported as having been carried out.

2. The following action has been taken:

(a) 2010/04 –Approval of an offer to settle a civil claim.
The following members were consulted: Kit Malthouse (Vice Chairman of the Authority) and Reshard Auladin (Chairman of Strategic and Operational Policing Committee). Members of the Strategic Operational and Policing Committee were consulted (by e mail) in advance of any decision being taken

The reason for urgency was considered and deemed appropriate as the claimant would withdraw an offer to settle and no MPA committee would be meeting before the deadline.

(b) 2010/05 late payment of invoices to solicitor.
The following members were consulted: Kit Malthouse (Vice Chairman of the Authority) and Reshard Auladin (Chairman of Strategic and Operational Policing Committee). Due to the extreme urgency of this matter it was not possible to consult with other members, however, notification that the urgent action had been taken was disseminated to members

(c) 2010/06 - request for the authority’s approval of an offer to settle a civil claim.
The following members were consulted: Kit Malthouse (Vice Chairman of the Authority) and Reshard Auladin (Chairman of Strategic and Operational Policing Committee). Members of the Strategic Operational and Policing Committee were consulted (by e mail) in advance of any decision being taken

The reason for urgency was considered and deemed appropriate as the claimant would withdraw an offer to settle and no MPA committee would be meeting before the deadline.

(d) 2010/07 - A request for urgent approval of funding for initial legal assistance regarding defamation that the MPS considers a major slur against the organisation.
The following members were consulted: Kit Malthouse (Vice Chairman of the Authority) and Reshard Auladin (Chairman of Strategic and Operational Policing Committee.

Following consideration the request was declined.

(e) 2010/08 - A request for urgent approval of funding for initial legal assistance regarding defamation that the MPS considers a major slur against the organisation.
Following further information provided by the MPS the MPA were asked to reconsider urgent action 2010/07. In doing so, the MPA approved the action but insisted on a cap for the funding.

The following members were consulted: Kit Malthouse (Vice Chairman of the Authority) and Reshard Auladin (Chairman of Strategic and Operational Policing Committee
Members of the Strategic Operational and Policing Committee were consulted (by e mail) in advance of any decision being taken.

The reason for urgency was considered and deemed appropriate as the officer concerned required legal advice urgently.

3. Copies of the urgent actions taken by the Chief Executive are available for inspection on request.
