A resolution was put to exclude the press and public from the meeting during the remaining agenda items as they would be likely to disclose exempt information as described in Part 1, Schedule 12A of the Local Government Act 1972 (as amended).

It was resolved that application should be made to the Home Secretary for a certificate of pension forfeiture.

16. Forfeiture of Police Pension

(Agenda item 8)

It was resolved that 30% of the ex-officer’s pension should be forfeited permanently following his conviction for misconduct in a public office,

17. Police Reform Act 2002 - Complainant

(Agenda item 9)

The MPA had received a complaint from a member of the public against an ACPO officer. Members agreed that as it was an issue of direction and control, the complaint should not be recorded.

The report also reminded members that the MPA had received several complaints that the Commissioner had failed to respond to complainants, although the MPS’s website specifically invited the public to write to him directly. The MPA had previously advised the MPS that the website should be amended to reflect that the Commissioner did not respond to complaints personally and to make it clear to whom a complainant should write. The MPS had not acted on this advice. Members therefore agreed that a letter should be written to the Commissioner requesting that action be taken and that the MPA’s Professional Standards and Complaints Committee should subsequently receive a report stating what action had been taken.

18. Police Reform Act 2002

(Agenda item 10)

The MPA had received a complaint from a member of the public concerning the use of police vehicles during the General Election in May 2005. Members agreed that this was not an incident of misconduct but agreed the issues involve should be explained to the public. Members’ felt there was a need for the MPS to revisit the protocol around the use of police vehicles and agreed that they should not carry political slogans, unless there was an operational necessity.
