1. Apologies for absence

3. Minutes of the Professional Standards Cases Sub-committee (Part 1): 15 March 2007 and 12 April 2007

Resolved - That the minutes of the Professional Standards Cases Sub Committee (Part 1): 15 March 2007 and 12 April 2007 be confirmed and signed as a correct record.

4. Exclusion of press and public

A resolution was put to exclude the press and public from the meeting during the remaining agenda item as it would be likely to disclose exempt information as described in Part 1, Schedule 12A of the Local Government Act 1972 (as amended).

Resolved – That the press and public be excluded from the meeting during the remaining agenda items.

5. Minutes of the Professional Standards Cases Sub-committee (Part 2): 15 March 2007 and 12 April 2007

The minutes of the Professional Standards Cases Sub Committee (Part 2) were agreed.

At its meeting in April, Members had been reminded that the Sub Committee had determined that complaints against two ACPO officers be recorded and referred to the IPCC. It had concluded that the complaints related to matters of direction and control and should be referred back to the MPA for consideration. The Deputy Chief Executive and Solicitor to the Authority had stated that whilst no action was necessary in relation to the officers’ conduct, there might be matters for the Sub Committee to consider in relation to issues of standard of service issues. Members agreed that an analysis of the complaints and any recommendations concerning standard of service issues should be presented as a report to the next meeting of the Sub Committee. The Deputy Chief Executive stated that the report had yet to be completed and would be submitted to the next committee in September.

6. Police Pensions Regulations 1987 - application for certificate

The Sub-Committee was asked to consider whether the offences for which an ex officer was convicted were committed in connection with his service as an officer in the MPS. Members agreed that the offences were committed in connection with his service. They therefore agreed that an application should be made to the Home Secretary for a certificate of forfeiture.

7. Police Pensions Regulations 1987 - application for certificate

Members received a report asking the Sub-Committee to consider whether the offence for which an ex officer was convicted was committed in connection with his service. Members considered that it could not be argued that the offence was committed in connection with his service. They therefore agreed that no application should be made to the Home Secretary for a certificate of forfeiture.

Members received a report setting out an ex officer’s service and convictions and were asked to consider whether the offences were committed in connection with his service. Members agreed that the offences were and therefore agreed that an application should be made to the Home Secretary for a certificate of forfeiture.

9. Additional oral item

(Agenda item 9)

The Deputy Clerk stated that he had received a report from the MPS concerning an officer who had committed various offences that were unconnected with his service. If the case were submitted to the Sub Committee, he would have to recommend that no application be made to the Home Secretary for a certificate of forfeiture. Rather than waste members time in reading such cases, it was therefore agreed that authority be delegated to him, in consultation with the Chair of the Sub Committee, to make such a decision without reference to Sub Committee members.
