47. Declarations of interests

John Roberts stated that he had sat on the Police Tribunal of the ex officer for whom pension forfeiture was to be considered at item 8. However, consideration of pension forfeiture was adjourned so that the officer might make oral representation to the Sub Committee.

48. Minutes of the Professional Standards Cases sub committee (Part 1): 15 November 2007

(Agenda item 3)

It was noted in relation to a business interest appeal that the MPS’s mishandling of the case and inadequacy of the legal advice provided be raised with the MPS. Members were informed that Deputy Chief Executive and Solicitor to the Authority had received a letter from the Deputy Director, HR and Training and Development, agreeing with the Sub Committee’s view and that the MPS performance in relation to the concerns raised would be improved.

RESOLVED - That the minutes (Part 1) of the Professional Standards Cases Sub Committee held on 13 November 2007 be confirmed and signed as a correct record.

A resolution was put to exclude the press and public from the meeting during the remaining agenda item as it would be likely to disclose exempt information as described in Part 1, Schedule 12A of the Local Government Act 1972 (as amended).

Resolved – That the press and public be excluded from the meeting during the remaining agenda items.

51. Police Reform Act 2002 - Complaint against an officer of ACPO rank

(Agenda item 6)

It was resolved that an MPS officer of ACPO rank be appointed by the Deputy Chief Executive to investigate the complaint against an officer of the same rank in respect of a complaint for which the IPCC would not grant discontinuance and the complainant would not consider local resolution.

52. Police Reform Act 2002 Complaint against an officer of ACPO rank

(Agenda item 7)

Members considered a report prepared by a Chief Constable in respect of an ex officer of ACPO rank. It was agreed that no further action should be taken in respect of the matters dealt with within the report, and that the report, with minor redactions be disclosed to the complainant, with the police service involved having first been informed of this course of action.

53. Police Pensions Regulations 1987 - Pension forfeiture

Consideration of this pension forfeiture was be adjourned, as the officer had made a late application to give oral representation.

54. Police pensions regulations 1987 - Application for a certificate

(Agenda item 9)

It was agreed that two ex officers had been convicted of offences in connection with their service as a member of a police service; and that an application should be made to the Home Secretary for a certificate of forfeiture.
