Summary

This brief report sets out the current MPS policy in respect of HIV and policing. A further report may be required to expand on the issues raised at the presentation at the meeting.

A. Recommendation

The Board is asked to note the contents of this report.

B. Supporting information

1. In July 2000 following representations from the MPA, the MPS published a policy to cover its employer responsibilities for staff who may be HIV positive.

2. Occupational Health drew up the policy in consultation with the Lesbian and Gay Police Association, Terrence Higgins Trust.

3. The policy gave a brief summary of how HIV could be transmitted and advice as to how the risk of transmission could be avoided whilst in the workplace.

4. The policy covers all staff, police officers, civil staff and special constables.

5. The policy covered issues of equality, stating that there would be no discrimination in respect of any staff who was either HIV positive or were affected by AIDS.

6. The policy set out the position in respect of health and well-being encouraging staff to discuss their HIV status with Occupational Health medical officers who could assist in advising on workplace modifications that may be required.

7. The policy also made a clear statement regarding confidentiality.

8. Staff are not required to declare their HIV status.

C. Equality and diversity implications

The Disability Discrimination Act, currently applicable to civil staff is set to apply in employment terms to police officers in October 2004. It is anticipated that the Government will extend the definition of disability under the Act to apply from the date of diagnosis in the case of HIV rather than having to prove that they have a progressive condition. No date for this change has been announced.
