Summary

This paper provides management information about MPS Employment Tribunal cases including financial data, together with details of those Employment Tribunals currently pending, which have been categorised as exceptional or significant.

B. Supporting information

1. Six monthly reports are provided to the Human Resources Committee setting out statistical data regarding MPS performance in terms of the conduct of Employment Tribunals brought against the Commissioner. Case details are also provided relating to those claims deemed to be exceptional or significant against criteria agreed with the MPA as defined in the MPA/MPS protocol.

2. The unit responsible for managing Employment Tribunals in the MPS, formerly P2, is now part of the Directorate of Professional Standards. It is intended that in future a comprehensive document with details of all liabilities in terms of exceptional and significant claims against the MPS including civil actions and accident claims will be provided to the MPA. This will be the subject of discussion with the Clerk to the Authority. It is intended that a separate table of Employment Tribunals will be maintained for the information of the Human Resources Committee.

3. The table at Appendix 1 shows MPS Employment Tribunal performance from 1996 to 30 September 2001. Total tribunal award and settlement figures are included. Annex A provides a breakdown of cases settled during 2001 and Annex B shows the single case lost in 2001.

4. Appendix 2 presents the Employment Tribunal performance data in a format requested by the Human Resources Committee meeting on 19 April 2001 to compliment and expand on the other forms of presentation of this data.

5. Appendix 3 (exempt item) lists the exceptional/significant Employment Tribunal cases currently being pursued against the Commissioner. This is the first presentation of case information in this format and further refinement may be appropriate following its perusal by the Committee.

Settlements of cases lost at tribunal hearing

Additionally in 2000, £451,500 was paid in settlements prior to Remedies Hearings for cases lost at tribunal. These five cases have been included as cases lost in 2000 above but cannot then be included as settlements or they will be double counted.

Settlement of case prior to hearing in the High Court

A High Court writ was also settled in 2000 prior to hearing for the sum of £215,000.
