1. Election of Chair

4. Minutes of the Police Pensions Forfeiture Sub Committee – 5 January 2004

The Sub Committee considered the minutes of the Sub Committee meeting held on 5 January 2005.

Resolved – That the minutes of the meeting held on 5 January 2005 be confirmed and signed as a correct record.

5. Exclusion of press and public

A resolution was put to exclude the press and public from the meeting during items 6, 7, and 8 as it was likely to disclose exempt information as described in paragraph 1, schedule 12a of the Local Government Act 1972 (as amended).

6. Exempt minutes of the Police Pensions Forfeiture Sub Committee – 5 January 2004

The Sub Committee considered the exempt minutes of the Sub Committee meeting held on 5 January 2004.

Resolved – That the exempt minutes of the meeting held on 5 January 2004 be confirmed and signed as a correct record.

7. Oral update on appeal hearings

(Agenda item 7)

Members had at earlier meetings been informed that some ex-officers had appealed against decisions made by the Police Pension Forfeiture Sub Committee to forfeit part of their pensions. The cases were heard at Snaresbrook Crown Court. A letter from Judith Chrystie, a solicitor seconded to the MPA, to the Deputy Clerk and Solicitor to the Authority was tabled. It informed members that judgement was delivered on 30 April and summarised the findings. The court had also made some suggestions concerning the MPA forfeiture procedure. Members agreed that these recommendations should be discussed with the Police Federation and by the Human Resources Committee at a future date.

8. Police pension forfeitures – potential applications to the Home Secretary for certificates of forfeiture

(Agenda item 8)

Members considered five potential applications to the Home Secretary for certificates of forfeiture. In each case, members reviewed all the papers provided for each case and analysed the criteria to be fulfilled, before making a decision regarding whether to apply for a certificate of forfeiture from the Home Secretary. It was resolved that applications be made to the Home Office for certificates for forfeiture in respect of four of ex-officers.
