20. Minutes of the Police Pensions Forfeiture Sub-committee – 25 November 2004

The Sub Committee considered the minutes of the Sub Committee meeting held on 25 November 2004. It was considered that the last part of the last paragraph in agenda item was unnecessary as magistrates’ courts made use of prisons’ video conferencing facilities.

At an earlier meeting members had requested they be given details of previous decisions to use as a benchmarking tool, although they had been advised that previous decisions should not be treated as a tariff and each case should be considered on its own merits. It was agreed that that the no names should appear on these details in the future.

It was noted that members had still not seen the recalculations made as a result of the decision taken by the Human Resources Committee on 22 July 2004, that all forfeiture decisions taken by the MPA since July 2000 would be re-calculated to reflect that the secured element of a pension (reflecting the officer’s own contributions), which had now been actuarially assessed in February 2004 at 35% rather than 25%.

Finally, it was agreed that appeals should be a standing item on the agenda.

Resolved – That

  1. the minutes of the meeting held on 17 May 2004 be confirmed and signed as a correct record; and
  2. ‘appeals’ be a standing item on future agendas.

21. Exclusion of press and public

A resolution was put to exclude the press and public from the meeting during items 6, 7, and 8 as they were likely to disclose exempt information as described in paragraph 1, schedule 12a of the Local Government Act 1972 (as amended).

Resolved – That the press and public be excluded from the meeting during discussion of agenda items 6, 7 and 8.

23. Police Pensions Forfeiture cases

(Agenda item 7)

The Committee considered three of four cases before them.

In the first three cases they considered the amount of pension up to 65% that should be forfeited by ex-officers imprisoned for offences. Members reviewed all the papers provided, and analysed the criteria to be fulfilled before resolving that respectively 25%, 55% and 15% of three ex-officer’s pensions should be forfeited permanently. The fourth ex-officer had asked to make personal representation to the Sub Committee. He failed to appear and members decided to defer consideration of his pension forfeiture to another day.
