59. Election of Chair

(Agenda item 1)

Resolved – That Cindy Butts be appointed Chair for this meeting. (It was latter agreed that Rachel Whittaker should chair the Committee for item 9)

60. Apologies for absence

No apologies were received.

61. Declarations of interests

(Agenda item 3)

It was noted that Cindy Butts had been a member of the Police Appeals Tribunal that dealt with the case of one of the cases below. It was agreed that the officer concerned should be asked if he had any objection to Cindy Butts being a member of the Committee that considered the forfeiture of his police pension. Officers undertook to avoid such a potential conflict in future.

62. Update on appeals

Members received an update on appeals against pension forfeiture.

Resolved – That the update be received.

63. Process for dealing with Police Pensions Forfeitures (arrangements for the selection of individual cases)

(Agenda item 5)

Members of the Police Pension Forfeiture Sub-Committee had requested a report on arrangements in place to identifying cases where an officer had committed a recordable offence in connection with his/her service as a member of a police force. It proposed that current practice should be revised to ensure that members were advised of all cases, including those cases where an officer has been convicted of a recordable offence.

Resolved – That

  1. the proposed amendment to the arrangements for reporting the selection of individual cases to the Sub-Committee be agreed; and
  2. that this information be reported to the Sub-Committee annually.

64. Exclusion of press and public

(Agenda item 6)

A resolution was put to exclude the press and public from the meeting during items 7 and 8 as they were likely to disclose exempt information as described in paragraph 1, schedule 12a of the Local Government Act 1972 (as amended).

Resolved – That the press and public be excluded from the meeting during discussion of agenda items 9 to 11.

The appendices to the report at agenda item 6 were exempt.

66. Forfeiture of pensions

(Agenda item 8)

(This case was dealt with after agenda item 9). In view of the fact that Cindy Butts had been a member of the Police Appeals Tribunal that dealt with this case, it was agreed that Rachel Whittaker should act as Chair for this item.

After consideration, it was agreed that none of the officer’s pension be forfeited.

67. Police Pensions regulations 1987 - application for certificate

(Agenda item 9)

This case was dealt with before that agenda item 8). It was agreed an application should be made to the Home Secretary for a certificate of forfeiture.

Resolved – That an application should be made to the Home Office for a certificate of forfeiture.
