32. Election of Chair

(Agenda item 1)

Resolved – That Cindy Butts be appointed Chair for this meeting.

33. Apologies for absence

(Agenda item 2)

Apologies were received form Jennette Arnold, Anthony Arbour, Damian Hockney and Aneeta Prem. As the Sub Committee needed three members present to be quorate, the Chief Executive and Clerk of the Authority had, by delegated action, approved the appointment of Karim Murji to this particular meeting. He had received training in dealing with the Sub Committee’s business.

34. Declarations of interests

(Agenda item 3)

No declarations of interest were received. It was agreed that MPA officer would before cases were considered check whether members had attended a Police Appeals Tribunal in relation to the officer or had links with his/her borough.

Resolved – that MPA officers would check whether members had dealt previously with any case involving an ex officer to ensure that their independence and impartiality was not compromised.

35. Minutes of the Police Pensions Forfeiture Sub Committee – 1 December 2005

(Agenda item 4)

The minutes of the committee held on 1 December 2005 were agreed.

Members requested a report on outstanding cases. It was agreed that this would come to the next Committee meeting. In relation to the query as to the MPS’ policy concerning publicity of cases where an officer was convicted, the Chair requested a report from the MPS. It was agreed that the Professional Standards Officer would prepare a commissioning brief, which would be circulated, to the Chair of the committee for approval before submission to the MPS.

Resolved – That

  • the minutes of the Police Pensions Forfeiture Sub Committee held on 1 December 2005 be agreed; and
  • that a report be received on MPS press office involvement in publicity surrounding cases where an officer has been convicted.

36. Oral update on appeals

(Agenda item 5)

Members were informed that one appeal was outstanding. It had been adjourned until the 21 February 2006.

Resolved – That the update be received.

37. Exclusion of press and public

(Agenda item 6)

A resolution was put to exclude the press and public from the meeting during items 7 to 9 as they were likely to disclose exempt information as described in Part 1, paragraphs 1 and 7, of Schedule 12A of the Local Government Act 1972 (as amended).

Resolved – That the press and public be excluded from the meeting during discussion of agenda items 7 to 8.

It was resolved that 30% of the officer's pension should be forfeit permanently.

39. Police pension regulations 1987 - forfeiture of pension

(Agenda item 8)

It was resolved that 65% of the officer's pension should be forfeit permanently.

40. Minutes of the police pensions forfeiture sub committee – 1 december 2005

(Agenda item 9)

The exempt minutes of the Police Pensions Forfeiture Sub Committee held on 1 December 2005 were agreed.
