Resolved – That Anthony Arbour be appointed Chair for this meeting.

44. Minutes of the Police Pensions Forfeiture Sub-committee – 9 January 2006

(Agenda item 4)

The Head of Professional Standards suggested amendments to the minutes. It was agreed that that a revised version of the minutes would be presented at the next meeting of the sub Committee for agreement. It was also agreed that the actions from the previous meeting would be deferred to the next meeting.

Resolved – That

  1. agreement of the minutes of the Police Pensions Forfeiture Sub Committee (part 1) held on 9 January 2006 be deferred to the next meeting of the Sub Committee; and
  2. actions from the previous meeting be deferred to the next meeting.

45. Oral update on appeals

(Agenda item 5)

Members were informed that an appeal had been adjourned until the 21 February 2006. Another ex officer, whose pension had been considered recently, was also appealing against the decision made by the Committee.

Resolved – That the update be received.

46. Outstanding pension forfeiture cases

(Agenda item 6)

This item was withdrawn by the Deputy Clerk and Solicitor and Head of Professional Standards as they felt the contents were misleading. Members felt this should have been avoided. It was suggested that when this Sub Committee was subsumed into the new Professional Standards Cases Sub Committee and had a permanent Chair, the agenda be discussed at the Chair’s briefing. It was also agreed that the revised report contain timescales within which cases would be dealt with.

Resolved – That the report be noted.

47. Exclusion of press and public

(Agenda item 7)

A resolution was put to exclude the press and public from the meeting during items 8 and 9 as they were likely to disclose exempt information as described in Part 1, paragraphs 1 and 7, of Schedule 12A of the Local Government Act 1972 (as amended).

Resolved – That the press and public be excluded from the meeting during discussion of agenda items 8 and 9.

It was resolved that 60% of the officer's pension should be forfeit permanently.
