55. Oral update on appeals

Members were informed that on appeal an officer’s forfeiture of pension had been reduced form 25% to 20%. It had taken this decision because the ex officer had produced evidence that he was suffering from a progressive disorder and which would effect his future earning capacity. This had not been raised at the time the Sub Committee had considered the forfeiture. The court also felt that the MPA had not given weight to the ex-officer’s career history and commendations. It was noted that the court gave no weight to any delay, or double jeopardy, arguments frequently raised by ex officers whose pensions were being considered.

The Head of Professional Standards also asked members to consider a case due to be considered by the Sub Committee where the ex officer could not obtain access to legal representation as he was in prison. It was agreed that consideration of his case be deferred until his release. The Head of Professional Services informed members that she, in conjunction with the APA, was writing a protocol whereby officers in prison would be allowed to attend considerations of pension forfeiture in person.

Resolved – That the update be received.

56. Exclusion of press and public

A resolution was put to exclude the press and public from the meeting during items 8 and 9 as they were likely to disclose exempt information as described in Part 1, paragraphs 1 and 7, of Schedule 12A of the Local Government Act 1972 (as amended).

Resolved – That the press and public be excluded from the meeting during discussion of agenda items 8 and 9.

The Sub Committee, having considered the report and ex PC de Freitas’s comments concluded that an application should be made to the Home Secretary for a certificate of forfeiture.

58. Police Pensions regulations 1987 - Forfeiture of pension

Having considered all the facts in the case, members of the Sub Committee agreed that the 65% of the officer’s should be forfeit permanently.
