16. Apologies

Apologies for absence were received from Elizabeth Howlett (Deputy Chair) and Tony Arbour (member).
17. Declarations of interests from members of the committee

No declarations of interests were given by members.
18. Exclusion of the press and public
(Agenda item 3)
A resolution was put to exclude the press and public from the meeting during item 5 as it was likely to disclose exempt information as described in Schedule 12(a) (1) and 12 of the Local Government Act 1972 (as amended).
Resolved – That The press and public be excluded from the meeting during discussion of agenda item 5 and 6.

19. Current cases update
(Agenda item 4)
Members considered the case of an officer of ACPO rank who may have breached the Police Code of Conduct. The Sub Committee decided it had insufficient information to reach a decision and decided to ask Her Majesty’s Chief Inspector of Constabulary (HMCIC) to make preliminary enquiries, before reconsidering the complaint.
Members then considered a complaint against an officer of ACPO rank. Members agreed that complaint related to an issue of direction and control and was therefore not a complaint within the meaning of the Act, accordingly the MPA had no jurisdiction to consider the complaint. However, members agreed that a report should be requested from the Professional Standards Directorate to the Professional Standards and Complaints Committee on when complaints should be dealt with at OCU level and when by the Professional Standards Directorate.
20. Current cases update

Members were provided with an update on an investigation by an outside police service on complaints arising from an operation within the MPS.
The meeting finished at 10.55 am.
