1. Apologies for absence

3. Meeting notes

(Agenda item 3)

The Sub-Committee received the notes of the inquorate meeting of the Sub-Committee held on 29 July 2002.

4. ACPO relocation/removal allowance

(Agenda item 4)

The Sub-Committee considered a report by the Clerk on this allowance for officers from other forces transferring to the MPS at ACPO rank. This subject had initially been discussed at the inquorate meeting in July. Members noted that a decision had already been taken to set the allowance limit at £15,000, to extend the allowance to include the purchase of second homes and that the changes should take effect from 2001/02.

Resolved – That

  1. That the decisions to set the allowance limit at £15,000, to extend the allowance to include the purchase of second homes and that the changes should take effect from 2001/02 be confirmed
  2. the operating rules for the allowance be approved as set out in appendix 2 of the report subject to the following changes:
    1. a 100% allowance should be given in respect of second homes (and not 75% as proposed in the report)
    2. that there should be 100% recovery of this allowance in respect of a second home if the officer leaves the service within two years. Recovery should be tapered to zero over four years
  3. approval be given to the principle that officers should elect at the outset for reimbursement for ‘full’ relocation or for a ‘second home’ and that claims should normally be submitted within 18 months of appointment;
  4. the views of the Chief Police Officers’ Staff Association be sought on these proposals; and
  5. tax on this benefit would be to officers’ own account

5. ACPO appointments: age criteria in regulations for retirement

The Sub-Committee considered a report by the Clerk setting out the provisions of the regulations regarding age requirements for the retirement of ACPO rank police officers.

Members noted the report. What was now needed was an understanding of how to correct the anomaly between the MPS and other forces. Assistant Commissioner Hogan Howe said that he would raise this in the appropriate forum.

Resolved – That steps be taken to correct the anomaly whereby the retirement age for ACPO appointments in the MPS differs from the rest of the country.

6. Exclusion of press and public

(Agenda item 6)

Resolved

That the press and public be asked to leave the meeting during discussion of the remaining items of business because exempt information as defined in paragraph 1 of Schedule 12A of the Local Government Act 1972 is likely to be made known.

7. Oral updates

(Agenda items 7 and 8)

The Chair and officers gave an update on various issues.

The Chair asked the officers to check whether the letter to ACPO officers appointed prior to the creation of the MPA had been finalised.

With regard to intellectual property rights, it was

Resolved – That in the view of the Authority intellectual property rights rest with the MPS.

Assistant Commissioner Hogan Howe said that he would check whether the Senior Appointments Panel had yet set up a database, which included Superintendents with potential for ACPO rank, and the criteria being used for inclusion.

8. ACPO appointments

(Agenda item 9)

Updated list of current appointments

The Sub-Committee received an updated list of ACPO officers and fixed term appointments.

There were some concerns at some extensive reporting lines in the new management structure. It was also agreed that there should be specific reference to youth justice in the Community Safety and Partnership command.

The Sub-Committee noted a report on the forthcoming recruitment exercise.

9. Senior civil staff appointments

(Agenda item 10)

The Sub-Committee considered a report by the Commissioner on whether senior civil staff appointments should be on a fixed term or permanent basis. This report took account of the provisions of the Fixed Term Employees (Prevention of Less Favourable Treatment) Regulations 2002, which came into effect on 1 October 2002.

Resolved - That the approach recommended in paras 5 to 8 of the exempt report be approved.

10. Pay of senior civil staff

(Agenda item 11)

The Sub-Committee considered a report by the Commissioner seeking agreement to proposals relating to pay awards policy for MPS senior civil staff on permanent contracts, effective from 1 April 2002.

Resolved – That approval be given to:

  1. increases to the minimum and maximum points of the various pay ranges as set out in the recommendation to the exempt report
  2. pay awards for the senior civil staff in line with the range of increases set out in paragraphs 6 and 7 of the exempt report.

11. Remuneration of the MPA Clerk and Treasurer

(Agenda item 12)

The Sub-Committee considered a report by the MPA Head of Human Resources & Professional Standards.

Resolved

  1. That for the reporting year 2001/02 a pay increase identical to that for other MPA staff be approved; and
  2. that the Head of Human Resources investigate the use of a consultant to develop objectives of these posts and report back to the Chair, Deputy Chair and Chair of the Authority.
