Summary

This report gives details, for information, of action taken under delegated authority on the grounds of urgency.

A. Recommendation

That members receive the report.

B. Supporting information

1. Standing Order 6.1 provides for the Chief Executive or Treasurer to take decisions under delegated authority and in consultation with specified members where a decision is required urgently. Decisions taken in this way have to be reported to the next meeting of the Authority for information. This report must state which members were consulted. Under the urgency procedure, wherever possible the members of the relevant committee (or of the Authority if that would be the decision-making body) should be informed in advance of the proposal to take a decision. This action must also be reported as having been carried out.

2. The following action has been taken:

  1. 2009/06 - Financial assistance for legal representation
    This urgent action was taken by the Chief Executive in consultation with Reshard Auladin (Chairman of Strategic and Operational Policing Committee) and Steve O’Connell (Chairman of Finance and Resources Committee – in the absence to the Vice Chair of the Authority) and members of the Strategic Operational and Policing Committee were consulted (by e mail) in advance of any decision being taken
    The reason for urgency was considered and deemed appropriate as the inquest was due to commence in early January
  2. 2010/02 - Settlement of Civil Claim
    On Thursday 21 January 2010, DPS Civil Actions Unit identified that this case was one which would require authority from the MPA under the protocol to negotiate a settlement.
    A formal mediation session had already been arranged for Wednesday 27 January 2010.
    The next meetings of both the Full Authority and the Strategic and Operational Policing Committee are after 27 January 2010.
    The need for a decision before 27 January 2010, together with the sensitive nature of the report means that it is necessary for a decision to be made under the urgency process.
    Members of the Strategic Operational and Policing Committee were informed of this decision.

3. Copies of the urgent actions taken by the Chief Executive are available for inspection on request.
