Summary

The Committee is asked to appoint the Chair, Deputy Chair and membership of the Police Pensions Forfeiture and Remuneration Sub Committees up until the annual meeting in June 2005.

A. Recommendation

That

  1. the Committee appoint a Chair, Deputy Chair and the membership of the Police Pensions Forfeiture Sub-Committee; and
  2. the committee appoint a Chair, Deputy Chair and the membership of the Remuneration Sub-Committee.

B. Supporting information

1. Following the appointment of the Human Resources Committee at the Annual Meeting on 8 July 2004, the Committee is asked to appoint Chairs, Deputy Chairs and members to the Police Pensions Forfeiture and Remuneration Sub-Committee.

2. In doing so, the Committee are reminded that at the Authority meeting on 27 May 2004 it was agreed that the membership of the Police Pensions Forfeiture Sub-Committee should consist of a fixed membership of five members from this Committee. It was also agreed that in the event of one or more member being unable to hear a particular case and the quorum of three members can not be met, the Clerk has delegated authority to select another member for that meeting, initially from amongst the membership of the parent committee or failing that from the membership of the Authority as a whole.

3. With regard to the Remuneration Sub Committee, members should also be mindful of the requirement for a quorum of members, which is difficult to maintain if membership of the Remuneration Sub Committee is very small.

4. The terms of reference for the two sub committees are attached at Appendix 1 for information.

Appendix 1: Terms of reference

Police Pensions Forfeiture Sub-Committee

1. To determine whether forfeiture of a police officer’s pension should be considered because he or she has been convicted of an offence committed in connection with his/her service as a member of the police force which the Home Secretary may certify as either having been gravely injurious to the interests of the State or liable to lead to serious loss of confidence in the public service.

In the event of the Home Secretary issuing a certificate of forfeiture, to determine the proportion, if any, of the pension which may be forfeited permanently or temporarily.

The sub-committee’s membership will comprise at least three members of the Human Resources Committee (i.e. the membership may differ from meeting to meeting). The Clerk has delegated authority to convene a meeting of the sub-committee, subject to at least three members being available. Three members must be present for the meeting to be quorate

Remuneration Sub-Committee

ACPO ranks

1. To consider, for recommendation to the Human Resources Committee, any new pay ranges for all ACPO ranks. These will be subject to agreement at the Police Negotiating Board and ratification by the Home Secretary.

2. To consider and agree the pay and terms and conditions to be offered on appointment to ACPO ranks up to and including Assistant Commissioner. This will include the length of any fixed term appointment. To develop, in discussion with the Commissioner, the performance assessment regime and additional benefits over and above those to which these posts are entitled by Police Regulations. This will also include early retirement arrangements for all ACPO ranks.

3. To make recommendations to the Home Secretary in relation to the terms and conditions to be offered to the Commissioner and Deputy Commissioner.

Senior MPS civil staff

4. To consider recommendations from the Commissioner about the pay and terms and conditions, including early retirement or redundancy, for civil staff in pay bands 1 to 4. 5. To agree with the Commissioner those senior civil staff posts for whom the MPA will be involved with the process of selection. For the senior civil staff in band 1 to agree with the Commissioner and to implement a process which reflects the Authority’s intention to be involved in objective setting.

6. In consultation with the Chair of the Authority, to agree the level of salaries and salary increases for the Clerk and Treasurer.

Powers delegated to the Clerk

Authority is delegated to the Clerk, in consultation with members of the sub-committee and the Treasurer, to agree, in cases of urgency, any HR issues in respect of individual appointments to ACPO ranks and Senior MPS Civil Staff.
