Minutes of the ACPO Conduct Sub-committee meeting on 29 May 2003 held at 10 Dean Farrar Street, London SW1H 0NY.

Part 1

1. Election of Chair

(Agenda item 1)

It was agreed that Reshard Auladin would act as chair of the meeting.

Resolved – That Reshard Auladin chair the meeting.

2. Apologies for absence

(Agenda item 2)

Apologies were received from Rachel Whittaker.

3. MINUTES

(Agenda item 3)

Members considered the minutes (Part 1) of the Sub-Committee meeting held on 28 April 2003.

Resolved – That the minutes (Part 1) of the Sub-Committee meeting held on 28 April 2003 were agreed and signed as a correct record.

4. Declarations of interests from members of the Sub-committee

(Agenda item 4)

Reshard Auladin and Elizabeth Howlett made a declaration of personal interest in one of the exempt items to be discussed. They had received and accepted an invitation to visit Waterloo and Sangatte from the Home Office, via an officer to be discussed in part 2 of the meeting. The solicitors present, and David Riddle, as Monitoring Officer, advised that this did not appear to be a prejudicial interest. Moreover, the Sub-Committee were advised that the relevant test was whether an objective bystander would perceive any bias. It was noted that all MPA members had contact with ACPO officers, and that this should not prevent them from considering conduct issues. Owing to the particular nature of the allegations against the officer Reshard Auladin and Elizabeth Howlett stated that they would prefer not to take part in future discussions regarding the specific allegations against the officer. Both members confirmed that, given that the issues before the Sub-Committee were preliminary in nature, they were content to participate in the discussion and the decisions to be made by the Sub-Committee that day.

5. Exclusion of press and public

(Agenda item 5)

A resolution was put to exclude the press and public from the meeting during item 6 as it was likely to disclose exempt information as described in paragraph 1 of part 1, Schedule 12(a) of the Local Government Act 1972 (as amended).

Resolved – That the press and public be excluded from the meeting during discussion of agenda items 6,7 and 8.

The Sub-Committee considered investigations into the conduct of two ACPO rank officers.

7. Current cases update

(Agenda item 7)

The Sub-Committee were updated on current cases.

Resolved - That the minutes (Part 2) of the Sub-Committee meeting held on 28 April 2003 be agreed and signed as a correct record.
