Action taken under delegated authority

Report: 11
Date: 30 April 2009
By: Chief Executive

Summary

This report gives details, for information, of action taken under delegated authority on the grounds of urgency.

A. Recommendation

That members receive the report.

B. Supporting information

1. Standing Order 6.1 provides for the Chief Executive or Treasurer to take decisions under delegated authority and in consultation with specified members where a decision is required urgently. Decisions taken in this way have to be reported to the next meeting of the Authority for information. This report must state which members were consulted. Under the urgency procedure, wherever possible the members of the relevant committee (or of the Authority if that would be the decision-making body) should be informed in advance of the proposal to take a decision. This action must also be reported as having been carried out.

2. The following action has been taken:

(a) 2009/02 – Proceeds of Crime Act – to support a bid being considered by government ministers

The following members were consulted: Kit Malthouse (Vice Chairman of the Authority), Steve O’Connell (Chairman of Finance and Resources Committee) and Cindy Butts (Chairman Communities Equalities and Diversity Committee – as MPA representative on SLF and in absence of Deputy Chair of Finance and Resources Committee). Members of the Finance and Resources Committee were informed of the action being taken by e mail.

The reason for urgency was considered and deemed appropriate. The matter was to have been considered by the cancelled Finance and Resources Committee on 19 February 2009 and it was considered that it could not be considered in the short reconvened meeting on the 5 March, as discussions were taking place with Government ministers on the 4 March. .

3. Copies of the urgent actions taken by the Chief Executive are available for inspection on request.

C. Race and equality impact

Any implications are addressed in the delegated action forms.

D. Financial implications

Any implications are addressed in the delegated action forms.

E. Background papers

Delegated action forms, unless they contain exempt information
