Summary

This report gives details, for information, of action taken under delegated authority on the grounds of urgency.

A. Recommendation

That members receive the report.

B. Supporting information

1. Standing Order 6.1 provides for the Chief Executive or Treasurer to take decisions under delegated authority and in consultation with specified members where a decision is required urgently. Decisions taken in this way have to be reported to the next meeting of the Authority for information. This report must state which members were consulted. Under the urgency procedure, wherever possible the members of the relevant committee (or of the Authority if that would be the decision-making body) should be informed in advance of the proposal to take a decision. This action must also be reported as having been carried out.

2. The following action has been taken:

  1.  2009/03 – Funding for legal representation
    The following members were consulted: Kit Malthouse (Vice Chairman of the Authority) and Reshard Auladin (Chairman of Strategic and Operational Policing Committee). Members of the Strategic Operational and Policing Committee were consulted (by e mail) in advance of any decision being taken
    The reason for urgency was considered and deemed appropriate as a pre invest review was scheduled for early December and decision required to enable legal representation at the review.
  2.  2009/04 – Settlement of civil litigation
    This request for urgent action was taken by the Chief Executive in consultation with Kit Malthouse (Vice Chairman of the Authority), and Reshard Auladin (Chairman of Strategic and Operational Policing Committee). Due to the extreme urgency of this matter it was not possible to consult with other members, however, notification that the urgent action had been taken was disseminated to members.
    This matter was extremely urgent as a decision was required as part of a mediation settlement process.
  3.  2009/05 - Financial settlement of two Employment Tribunal applications
    This urgent action was taken by the Chief Executive in consultation with Kit Malthouse (Vice Chairman of the Authority), and Reshard Auladin (Chairman of Strategic and Operational Policing Committee) and members of the Strategic Operational and Policing Committee were consulted (by e mail) in advance of any decision being taken
    The reason for urgency was considered and deemed appropriate in order for a settlement to be reached and as there were no committee scheduled to take place to consider the request.
  4.  2010/01 - Transforming HR
    This urgent action was taken by the Chief Executive in consultation with Vice Chairman and Steve O’Connell (Chairman of the Finance and Resources Committee). As part the consultation process members of the Finance and Resources Committee were informed of the request.

The reason for urgency was considered and deemed appropriate as there was a potential time critical business risk to the MPS and consequential attrition of business benefits.

3. Copies of the urgent actions taken by the Chief Executive are available for inspection on request.
