Action taken under delegated authority

Report: 11
Date: 25 March 2010
By: Chief Executive

Summary

This report gives details, for information, of action taken under delegated authority on the grounds of urgency.

A. Recommendations

That members receive the report.

B. Supporting information

1. Standing Order 6.1 provides for the Chief Executive or Treasurer to take decisions under delegated authority and in consultation with specified members where a decision is required urgently. Decisions taken in this way have to be reported to the next meeting of the Authority for information. This report must state which members were consulted. Under the urgency procedure, wherever possible the members of the relevant committee (or of the Authority if that would be the decision-making body) should be informed in advance of the proposal to take a decision. This action must also be reported as having been carried out.

2. The following action has been taken:

  1. 2009/03 – Consideration of legal advice
This request for urgent action was taken by the Deputy Chief Executive in consultation with Kit Malthouse (Chair of the Authority) and James Cleverly (Vice Chairman of the Professional Standards Cases Sub Committee). Members of the Professional Standards Cases Sub Committee were consulted (by email) in advance of any decision being taken. The reason for urgency was considered and it was deemed appropriate as it was not in the public interest for consideration of the legal advice to be delayed until the next meeting of the Sub Committee.”

3. Copies of the urgent actions taken by the Chief Executive are available for inspection on request.

C. Race and equality impact

Any implications are addressed in the delegated action forms.

D. Financial implications

Any implications are addressed in the delegated action forms.

E. Legal implications

None given.

F. Background papers

  • Delegated action forms, unless they contain exempt information
